R-visa for members of a recognized religious community

The R visa allows members of certain recognized religious communities to enter the USA temporarily for the purpose of work. In some cases, the B-1 visa may also be suitable for this purpose.

In order for the R visa to be granted, the religious community must meet certain requirements. It must be a recognized, non-profit (“bona fide”) and tax-exempt religious community in the USA. At the very least, the requirements for tax exemption in the USA must be met. If necessary, the religious community must prove that it has sufficient funds to adequately remunerate the applicant for its activities.

The visa applicant must be a regular member of the respective religious community, i.e. for at least two years. Eligible for the R visa are

The R visa can be issued for a maximum period of five years. After an absence from the USA of one year, it can be applied for again.

Prior to the actual visa application at the responsible US consulate, the employer, i.e. the religious community, must submit a so-called I.129 petition to the US immigration authority USCIS.
