K-visa for persons who are engaged or married to an American
The K1 visa is the so-called fiancée visa and can be applied for by persons who are engaged to a US citizen. After marriage, there is also an option for a green card.
The applicant for the K1 visa must first submit a so-called I.129-F petition to the USCIS immigration authority. Among other things, it must be demonstrated that the marriage is not merely a sham marriage aimed purely at obtaining a green card. Proof that it is not a marriage of convenience can be provided, for example, if the fiancées have met in the two years prior to the application and have spent a certain amount of time together.
The actual K1 visa can then be applied for at the US consulate in Germany, where a number of forms and supporting documents must be submitted. It is also regularly necessary for the applicant to appear in person and undergo a medical examination.
The K1 visa is then valid for a period of 6 months and allows a stay of 90 days without the possibility of an extension. The wedding can take place within the 90 days. After the wedding, you can apply for a green card for your further stay in the USA.
